General terms and conditions of sale

The present conditions of sale are concluded on the one hand by the auto-entrepreneur CHEVALLEREAU Pascal, the seller, and on the other hand, by any individual or legal entity hereinafter referred to as the buyer wishing to make a purchase via the Internet site www.diaporashop.com.

Article 1 - Scope of application

The present conditions of sale aim to define the contractual relations between the seller and the buyer. The conditions applicable to any purchase made through the merchant site www.diaporashop.com whether the buyer is a professional or a private individual.

The acquisition of a property through this site implies an unreserved acceptance by the buyer of these terms and conditions of sale.

These conditions of sale shall prevail over any general or special conditions not expressly approved by the auto-entrepreneur CHEVALLEREAU Pascal.

The auto-entrepreneur CHEVALLEREAU Pascal reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the site www.diaporashop.com on the date of the order placed by the purchaser.

It is understood that persons considered legally incapable of contracting within the meaning of articles 1123 and following of the Civil Code, in particular non-emancipated minors, must obtain the authorisation of their legal representative prior to any order.

Article 2 - Description of products

The products presented on the www.diaporashop.com website are sold by downloading files. Downloading means the transmission and reproduction of a file chosen by the buyer, on a suitable electronic device connected to the Internet.

In accordance with the provisions of article L.111-1 of the Consumer Code, the presentation of the products on the site allows the buyer, before the conclusion of the contract, to know the essential characteristics of the products he wishes to order.

The products offered for sale are described and presented as accurately as possible with the help of videos and photos that illustrate as faithfully as possible the effect achieved. However, the videos, photos and texts present on the site are only indicative and do not in any way engage the responsibility of the auto-entrepreneur CHEVALLEREAU Pascal in case of error in the erroneous graphic representation of a product or even affect the validity of the sale.

Article 3 - Orders

Orders are taken via the dematerialised order form or "basket", accessible online at www.diaporashop.com.

The ordering process is as follows:

  • Choice of articles and addition to the basket
  • Validation of the contents of the basket
  • Identification of the buyer on the site www.diaporashop.com if he is not already identified
  • Choice of payment method and acceptance of the Terms and Conditions of Sale by a checkbox and a validation click
  • Validation of the payment.
  • The buyer communicates the requested information necessary for the realization of the order.
  • The buyer is identified by means of his e-mail address.
  • The buyer has the possibility to check the details of his order before validating it definitively.
  • The buyer accepts the order by clicking on "validate" after having chosen the methods of his payment and entered the indications requested to allow this one in the zones provided for this purpose.

By confirming his order, the buyer declares that he has read all of these General Terms and Conditions of Sale and accepts them without restriction or reservation. When an order is successfully placed on the www.diaporashop.com website, the buyer receives confirmation by e-mail to the address he indicated when placing the order. The sale is deemed effective upon receipt of this e-mail.

The auto-entrepreneur CHEVALLEREAU Pascal reserves the right to cancel any order from a buyer with whom there is a dispute concerning the payment of a previous order.

Orders placed are automatically recorded and these records constitute proof as to the description of the order, its date, its contents and the price in effect at the time of purchase.

The information communicated by the buyer during the ordering process is his responsibility as to its accuracy.

Article 4 - Rates - Billing

The products are supplied at the current rates shown on the site, at the time of acceptance of the order by the auto-entrepreneur CHEVALLEREAU Pascal.

The prices indicated in Euros are final prices, expressed net of tax insofar as the auto-entrepreneur CHEVALLEREAU Pascal is not subjected to the VAT (Art. 293B of the CGI). Being dematerialized products, no expenses are invoiced in addition, with the possible exception of expenses taken by the banking establishment of the purchaser independently of the activity and the invoicing established by the salesman.

Invoices for all orders placed are issued immediately upon order and sent exclusively by electronic means.

Article 5 - Terms of payment

The price is payable cash, in full, on the day the order is placed by the buyer.

Payment by credit card is made online via the PayPal service, the buyer will then be directed to his PayPal account in order to make the payment.

The www.diaporashop.com site uses the PayPal secure payment system, the bank responsible for online payment has confidential information that is inaccessible to a third party.

Once the payment is initiated by the buyer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information at the time of the sale, the buyer authorises the seller to debit his card for the amount relating to the price indicated. The buyer confirms that he is indeed the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately cancelled by operation of law and the order is cancelled.

Article 6 - Receipt of ordered products

The products of the www.diaporashop.com site are sold only in a dematerialized format. No physical product is shipped. When an order is validated, the buyer receives an e-mail to the e-mail address he has communicated. This e-mail contains a download link that allows the buyer to access the purchased content which is in the form of an archive file in .zip format.

He can also access these links, as well as the invoices for orders placed, by logging into his account on the www.diaporashop.com website.

The buyer has three attempts within 21 days of placing the order to download the product. If he encounters any difficulty during this process, he is invited to contact customer service via the "Contact" form provided for this purpose and available on each page of the www.diaporashop.com website.

The buyer undertakes not to communicate either the link received, or the files downloaded in whole or in part following an order, to third parties, whether free of charge or in return for payment. The products purchased at the time of his order are reserved for strictly personal use.

Article 7 - Right of withdrawal

In accordance with the law in force (Consumer Code, section 6, article L221-28), the sale of digital content on an intangible medium is not affected by the right of withdrawal insofar as the buyer acknowledges waiving this right.

Given the nature of the products supplied and the impossibility for the buyer to guarantee the return to the seller and/or the deletion of any occurrence of the documents purchased and downloaded on his own computer equipment, the buyer acknowledges that he renounces his right of retraction as soon as he downloads the purchased files.

On the other hand, if the buyer wishes to cancel and obtain a refund of his order and it is established that he has not downloaded anything, he may contact customer service via the Contact form available on the site at www.diaporashop.com/contact. Under these conditions, the buyer has the statutory period of fourteen days to make this request (Consumer Code, section 6, article 221-18 applicable to distance selling).

Article 8 - Contact

For any question relating to an order or in the event of difficulties in particular in the event of non-receipt of an e-mail from the seller or difficulties related to the downloading of products, the buyer is invited to contact the seller by e-mail at the following address contact@diaporashop.com.

Article 9 - Liability

The seller can in no way be held responsible for the consequences or damages of any kind that could result from the misuse of the products sold.

Once the purchase procedure is completed, the buyer is responsible for the files received and cannot request their replacement free of charge if he deletes, loses or modifies them.

Article 10 - Applicable law

The present conditions are subject to French law only. The same is true for the rules of substance as for the rules of form. In the event of litigation or complaint, the consumer will address in priority to the auto-entrepreneur CHEVALLEREAU Pascal to obtain an amicable solution. In a second time and in case of appeal, the consumer will be able to lodge a complaint with the French courts, only competent.

The seller cannot be held responsible for the non-respect of laws or legal provisions in force in countries other than France. Its liability is only committed up to the amount of the product concerned by the dispute.

The present conditions have been written in French and only the French language is authentic.

Article 11 - Data processing and liberties

The personal information collected for the purposes of distance selling is mandatory, this information being indispensable for the processing and routing of orders and the establishment of invoices. Failure to provide this information will result in the non-validation of the order.

In accordance with the law relating to data processing, data files and liberties of January 6, 1978, information of a nominative nature relating to the purchasers may be the subject of automated processing.

The auto-entrepreneur CHEVALLEREAU Pascal reserves the right to collect information on buyers.

The auto-entrepreneur CHEVALLEREAU Pascal undertakes not to communicate, whether free of charge or in return for payment, the contact details of his buyers to third parties.

Buyers may oppose the disclosure of their contact details by notifying the auto-entrepreneur CHEVALLEREAU Pascal. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.

Article 12 - Intellectual property

The content of the site is the property of the auto-entrepreneur CHEVALLEREAU Pascal, it is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offence of counterfeiting.

The products sold on the site www.diaporashop.com are reserved solely for the personal use of the buyer or the recipient of the product purchased. Any commercial use, such as resale of files, use of styles and transitions - without this list being considered exhaustive - is prohibited.

Any copy or distribution, free or paid, in private, in shops or on the Internet, is also prohibited.
